What to Bring to Your 341 Bankruptcy Hearing

In both Chapter 7 and Chapter 13 bankruptcy, you must attend the 341 hearing, also known as the meeting of creditors. The Trustee will preside over the hearing and you are required to present certain documents either before or during the hearing. Some of the documents are mandated by law, some by the procedures set in your district, and others by specific circumstances of your case.

The Bankruptcy Law requires that you submit a copy of the last tax return you filed to the Trustee. In general, your 341 hearing won’t proceed if you don’t comply and your case may be dismissed. Next, the Trustee needs to verify your identity so bring your driver’s license and original social security card. For joint filers, both parties should be present during the hearing and provide these two identification cards.
